PENYELESAIAN TINDAK PIDANA ANAK YANG BERHADAPAN DENGAN HUKUM BERDASARKAN PERATURAN KAPOLRI NOMOR 8 TAHUN 2021 TENTANG PENANGANAN TINDAK PIDANA BERDASARKAN KEADILAN RESTORATIF

Abstract
Settlement of juvenile criminal cases as stated above, can be resolved in the perspective of child protection, but on the other hand the process of enforcing criminal law must not injure the sense of justice. This study uses a type of normative legal research with a Conceptual Approach and Case Approach. The data used are secondary data in the form of primary, secondary and tertiary materials obtained through literature studies or document studies. The results of this study indicate that legal proceedings against children who are in conflict with the law based on the Chief of Police Regulation Number 8 of 2021 concerning the Handling of criminal acts based on restorative justice can currently only be carried out for minor crimes as long as they comply with the requirements and procedures regulated in the regulation. the settlement of this crime does not yet have legal legitimacy, does not guarantee that there will be no legal problems when there is dissatisfaction between parties (perpetrator, victim, perpetrator/victim's family and local community) after restorative justice, so it is still possible for this case to proceed with the legal process. Anticipate the implementation of the Chief of Police Regulation Number 8 of 2021 concerning Handling of criminal acts based on restorative justice.
